PilotCommute Terms of Use — v1.0 DRAFT

Operator / seller: Flight Level Ventures LLC, a Texas limited liability company
Contact: pilotcommuteapp@gmail.com
Status: DRAFT — internal only. Not published. Nothing submitted without Tyler’s final go.
Not legal advice. Limitation of liability and warranty language is marked COUNSEL (recommended before scale; attorney review deferred per CEO 2026-10-27).

1. What PilotCommute is

PilotCommute is an iOS planning tool for airline pilots who commute to their duty base. It can help you turn a crew schedule into suggested wake and leave times, suggest commute flights from public schedule data, show airport weather for general awareness, and try to set wake and leave alarms on your iPhone.

PilotCommute is not an airline, crew-scheduling system, union tool, or a weather briefing service for flight planning. It is not affiliated with or endorsed by any airline, pilot union (including ALPA), or government weather service.

2. Your responsibility

You alone are responsible for waking up, getting to your base, and reporting as scheduled. Always check your crew schedule and set an alarm you control. Confirm every time, flight, and plan with your airline before you rely on it.

PilotCommute can be wrong. Alarms may be late or may not go off. Times shown are estimates. The app tries to set alarms; iPhone or system settings may block, delay, or fail to deliver them.

3. Eligibility

You must be old enough to enter a binding agreement where you live and able to use the app lawfully. The app is intended for working airline pilots, not for children.

4. License

Subject to these Terms, Flight Level Ventures LLC grants you a personal, non-exclusive, non-transferable, revocable license to use the PilotCommute iOS app for your own commute planning. You may not reverse engineer, resell, or misuse the app, or use it to break airline, union, or other rules that apply to you.

5. Third-party data

Flight status and schedule suggestions may come from FlightAware. Weather may come from NOAA (aviationweather.gov). Lookups may pass through infrastructure operated for PilotCommute (including Cloudflare). Third-party data may be delayed or wrong. Seats, gates, equipment, and schedules can change. Weather in the app is for general awareness only, not a weather briefing for flight planning—use your airline’s and aviation weather sources for flight planning.

6. No airline or union affiliation

Airline names appear only as compatibility facts (for example, which schedule formats the app can read). No airline or union logos. Nothing in the app is a contract ruling, a union interpretation, or airline policy advice. Contract-based warnings and UPA23 contract content are being removed from the main app for all airlines; if any contract-based content remains in a build, its disclaimer stays.

7. Hands-free and automations

Hands-free calendar checks and related Shortcuts automations are optional. They sit behind opt-in controls and acknowledgements that are unticked by default. You can turn them off. Automations still depend on iOS, calendar updates, and your setup; they may miss changes.

8. Bug reports

If you send a bug report to pilotcommuteapp@gmail.com, you choose what to send. Nothing is sent until you tap Send in your mail app. See the Privacy Policy for retention (including the 90-day deletion practice for bug mail).

9. Disclaimer of warranties — COUNSEL

COUNSEL (recommended before scale). TO THE MAXIMUM EXTENT PERMITTED BY LAW, PILOTCOMMUTE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ALARMS WILL FIRE, THAT TIMES OR FLIGHT DATA WILL BE ACCURATE, OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability — COUNSEL

COUNSEL (recommended before scale). TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLIGHT LEVEL VENTURES LLC AND ANYONE PROVIDING PILOTCOMMUTE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PAY, MISSED TRIPS, DISCIPLINE, TRAVEL PRIVILEGE LOSS, OR SIMILAR LOSSES, ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ITS TIMES, ALARMS, OR DATA—EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE PLACES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

Note: The App Store seller and party to these Terms is Flight Level Ventures LLC, a Texas limited liability company. COUNSEL before scale on insurance.

11. Privacy

Your use is also governed by the Privacy Policy (https://pilotcommuteapp.com/privacy).

12. Changes

We may update these Terms. The effective date will change. Continued use after notice may mean you accept the updated Terms, except where law requires a different process. COUNSEL

13. Governing law

Governing law / venue: Governing law. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the app will be brought in the state or federal courts located in Texas, and you and we consent to their jurisdiction. Nothing in this section limits any rights you have under the consumer protection laws of the place where you live that cannot be waived by contract.

15. Subscriptions

15.1 No free tier

PilotCommute does not offer a free plan. After any free trial ends, you need an active paid subscription to get new alarms, alarm updates, commute flight lookups, and other plan features described in the app. There is no ongoing free feature tier.

15.2 Plans and prices

PilotCommute offers auto-renewing monthly subscriptions through Apple In-App Purchase. Plan names and USD reference prices (set in App Store Connect; the amount charged in your region may differ):

PlanUSD reference (monthly)Notes
Basic$6.99Wake/leave alarms and commute flight finder
Plus$9.99Basic, plus Go home, next-leg gate and airport weather
Pro$14.99Plus, plus logbook

The logbook is available on Pro only. Prices are set in the App Store and may vary by country or region, taxes, and App Store pricing rules. The price shown by Apple at purchase or renewal is the price that applies to you.

15.3 Free trial (Apple introductory offer)

Eligible users may get a one-month free trial as an Apple introductory offer before the first paid period. Eligibility is decided by Apple (typically one introductory offer per Apple Account / subscription group; Apple’s rules control). If you are not intro-eligible, Apple will show the paid price without a free trial.

Uncertainty (Apple): If you buy a plan while a trial is still running, Apple may end the unused trial time when the paid subscription starts. We do not control that timing; follow what Apple shows in the purchase sheet and in Subscriptions on your device. (Confirm current Apple behavior for unused intro time before locking public copy.)

About three days before the trial ends, the app may show an in-app reminder with the trial end date and the price that will apply after the trial unless you cancel.

15.4 Auto-renewal

Unless you cancel, your subscription renews automatically at the end of each period for the same plan length (monthly) at the then-current price for that plan in your storefront, subject to Apple’s price-change rules (see §15.7). Payment is charged to the payment method on your Apple Account.

15.5 How to cancel

Manage or cancel in device Settings (or the App Store account Subscriptions screen): open Settings → [your name] → Subscriptions → PilotCommute → Cancel Subscription (wording may vary by iOS version). Cancel at least 24 hours before the current trial or paid period ends if you do not want the next charge. Canceling stops future renewals; it does not undo a charge already made for the current period. Purchases, billing, and cancellation are handled by Apple, not by Flight Level Ventures LLC directly.

15.6 Refunds

Refund requests for PilotCommute subscriptions go through Apple only (for example reportaproblem.apple.com or the purchase/subscription tools Apple provides). Flight Level Ventures LLC does not process App Store subscription refunds.

15.7 Price changes

We may change subscription prices in App Store Connect. When Apple requires it, Apple will tell subscribers about an upcoming increase (and may ask for consent) using Apple’s own channels. If you do not agree to a price increase that requires consent, the subscription may end at the close of the then-current period under Apple’s rules. Price decreases for auto-renewable subscriptions generally apply at the next renewal under Apple’s guidance.

15.8 What happens when a trial or subscription ends (lapse)

If your trial or paid subscription ends and you do not renew:

Resubscribing restores plan features for new alarms, updates, and lookups according to the plan you buy.

15.9 Apple’s role and the Standard EULA

PilotCommute is distributed through the Apple App Store. Billing for subscriptions uses Apple In-App Purchase. Unless Flight Level Ventures LLC provides a custom EULA in App Store Connect that Apple accepts for your storefront, Apple’s Licensed Application End User License Agreement (Standard EULA) also applies to the app license. This Terms of Use section describes PilotCommute subscriptions offered by Flight Level Ventures LLC, a Texas limited liability company; it does not replace Apple’s subscription, billing, or refund processes.
